Terms of Use of StackJobs

1. OBJECT AND SCOPE OF APPLICATION

The General Terms of Use aim to define the rules applicable to access and use of our services (hereinafter "Services") via our website and its subdomains (hereinafter the "Site").

These GTU are a contract concluded between persons who browse the Site without having created an account (hereinafter "Reader"), and persons who have created a Member Space and have provided their personal information (hereinafter "Member"), jointly the "Users" or "You" and StackJobs, called individually the "Party" and jointly the "Parties".

Access to the Site is conditional on the acceptance and respect by Users of these GTU.

The GTU do not apply to services offered by third-party companies, operating websites and tools of our partners or other websites or tools accessible from our Site.

We may be required to modify these General Terms of Use from time to time. You are invited to consult this page regularly to ensure that you agree with any modification. In case of important modifications, you will be informed by a notification when you log into your Member Space.

2. SERVICES OFFERED VIA THE SITE

When you browse the site you can, without having to create a Member Space:

• Search, explore and view company pages and obtain information (information, videos, offers, news, etc.) about them via their pages (hereinafter "Company Showcase(s)")
• Consult job offers
• Explore articles and content on the theme of employment and recruitment
• Download our resources and in particular our guides on the theme of employer brand and recruitment
• Request a demonstration of our product and to be contacted by our teams

When you create an account on our site (hereinafter "Member Space") you will be able to benefit from the complete experience offered by StackJobs and in particular:

• Create and fill in your member profile to benefit from personalized support in your job search
• Be contacted by recruiters when you give your consent to make your profile information visible
• Browse, compare and apply for job offers available on the Site
• Manage the progress of all your applications within your Member Space

The Services are free services for Site Users. The distribution of job offers and access to our product are paid for recruiters.

3. TERMS OF CREATION AND USE OF THE MEMBER SPACE

3.1 Create your Member Space and a secure password

When the User creates a Member Space, they have the possibility to register via their LinkedIn profile, their Google account or via their email address. When registering via LinkedIn profile and Google account, your personal information will be pre-filled by our partners. If you opt for registration via your email address, you will need to fill out the form collecting the following information: first name, last name, email address and create a password.

Your password must be strong and meet our security requirements, it must remain strictly personal and confidential.

You are solely responsible for actions resulting from the use of your Member Space, regardless of whether you are the origin or not. This is why you guarantee:

• Not to allow any third party to use your Member Space on your behalf or for your account
• Take all appropriate measures to ensure the security, confidentiality of your password and identifier

4. USER OBLIGATIONS

By using our Services, you agree to:

• Respect applicable laws and regulations
• Not use the Services for illegal or fraudulent purposes
• Not infringe intellectual property rights
• Not disseminate defamatory, insulting or offensive content
• Not attempt to disrupt the operation of the Site
• Provide accurate and up-to-date information

5. INTELLECTUAL PROPERTY

5.1 StackJobs intellectual property

All content on the Site (texts, images, videos, logos, trademarks, etc.) is protected by intellectual property rights and belongs to StackJobs or its partners.

Any reproduction, distribution or use of all or part of the Site content in any form whatsoever, without the express and prior authorization of StackJobs, is prohibited and would constitute counterfeiting.

5.2 User intellectual property

Users integrate and disseminate content via the Site (application file, including CV, cover letter, texts, images, etc.) (hereinafter the "User Content"). As such, the User is and remains the holder of rights to said content.

However, the User grants to StackJobs, who accepts, a non-exclusive and free license to use the User Content for the needs of the execution of the Services.

6. PERSONAL DATA

StackJobs is concerned with preserving the confidentiality of your personal information and we attach great importance to protecting the privacy of Users of our Services. We are committed to respecting law n°78-17 of January 6, 1978 (known as the "Informatique et Libertés" law) as amended and the General Data Protection Regulation (known as "GDPR").

7. DURATION AND TERMINATION

The GTU are applicable to all Users until the effective deletion of the Member Space and the cessation of use of the Services.

By right, StackJobs may immediately suspend access to the Site and Services, in case of non-compliance with the General Terms of Use by the User. In this case, StackJobs will notify this suspension to the User by email, and will put them on notice to stop this violation.

8. LIABILITY

StackJobs strives to keep the Site accessible 24/7, but cannot guarantee permanent availability. StackJobs cannot be held responsible for service interruptions due to force majeure or necessary technical interventions.

StackJobs cannot guarantee the accuracy, completeness or timeliness of information disseminated on the Site by Users or companies.

StackJobs' liability may in no case exceed the amount of sums actually paid by the User during the 12 months preceding the event giving rise to the damage.

9. APPLICABLE LAW AND JURISDICTIONAL COMPETENCE

These General Terms of Use are governed by French law.

In case of dispute, the parties decide, first, to try to resolve it amicably. In case of failure, all disputes that may arise between the parties, relating to the signature, interpretation, execution and termination of these terms, will be submitted to the exclusive jurisdiction of French courts.
